Website Terms of Use

B.1. Scope and acceptance

B.1.1. These Website Terms of Use (the “Terms”) govern access to and use of the website operated at the domain zeronesecurity.com and its subdomains (the “Site”) by Zerone Siber Güvenlik Limited Şirketi (“Zerone”).

B.1.2. These Terms do not govern any subscription, licence or service relationship relating to the Zero Door product. Access to the Zero Door console (zerodoor.zeronesecurity.com) and use of the product are governed by the Zero Door Subscription and Terms of Service and the applicable Order Form, and for on-premises deployments by the Zero Door Software Licence Agreement. In the event of a conflict between these Terms and those agreements, those agreements prevail in respect of the product relationship.

B.1.3. Any person visiting the Site (the “Visitor”) agrees to comply with these Terms for the duration of the visit. A Visitor who does not accept these Terms shall not use the Site.

B.1.4. These Terms grant the Visitor a right of use only; no right in the Site is transferred to the Visitor.

B.2. Identity and contact details of the Site operator

B.2.2. The identifying information, the technical steps for concluding a contract, information on whether the contract text is stored and remains accessible, and the technical means for identifying and correcting input errors, each required under Article 3 of Law No. 6563 on the Regulation of Electronic Commerce, are set out in 62-kunye-ve-bilgi-toplumu-hizmetleri.md (Information Society Services Disclosure), which forms an integral part of these Terms.

B.3. Nature of the content

B.3.1. Product descriptions, technical articles, compliance materials, references to legislation, guides, comparison tables and blog posts published on the Site are provided for general information purposes only. They do not constitute legal advice, engineering advice, audit services or technical recommendations for any specific matter.

B.3.2. References to legislation reflect the texts in force at the date of publication. Legislation is subject to change, and the Visitor shall verify the rules applicable to its own circumstances against current official sources.

B.3.3. Statements on the Site concerning product capabilities do not replace the commitments set out in the agreement concluded between Zerone and the Customer. Binding commitments arise solely from the executed agreement, the Order Form and their annexes.

B.3.4. Zerone may update the content and structure of the Site, withdraw any part of it, or make the Site temporarily unavailable, at any time. No availability commitment is given in respect of the Site. Availability commitments in respect of the Zero Door service are set out separately in the Service Level Commitment.

B.4. Intellectual property rights

B.4.1. The texts, images, videos, graphics, databases, page layouts, design elements, source code and documentation on the Site are protected under Law No. 5846 on Intellectual and Artistic Works. Pursuant to Article 2(1) of that Law, computer programs and their preparatory design work qualify as scientific and literary works. The economic and moral rights in such content belong to Zerone or to its licensors.

B.4.2. The names “Zero Door” and “Zerone”, together with the logos, emblems and distinctive signs used on the Site, are trade names and marks of Zerone. Their use is governed by 72-marka-kullanim-kilavuzu.md (Trademark and Trade Name Usage Guidelines). The product name shall be written as two separate words, “Zero Door”.

B.4.3. The Visitor may view the Site content for personal or internal evaluation purposes, cache it temporarily in the browser, print a reasonable number of copies, and quote short extracts with attribution to the source. Any other reproduction, distribution, adaptation, communication to the public, commercial exploitation or creation of derivative content requires Zerone’s prior written consent.

B.4.4. Where components are made available on the Site under an open source licence, the terms of that licence prevail over this Section in respect of those components.

B.5. Permitted and prohibited uses

B.5.1. The Site may be used to obtain information about Zerone’s products and services, to make contact, and to access the documents published on it.

B.5.2. The Visitor shall not:

bAccess the Site contrary to the rules stated in the robots.txt file, or send automated requests exceeding applicable rate limits
cConduct vulnerability scanning, penetration testing, brute force attempts, load testing or comparable security testing against the Site without Zerone’s prior written consent
çInterfere with or overload the operation of the Site or connected systems, or generate traffic intended to cause denial of service
dCircumvent access controls, attempt to access unauthorised areas, or use another person’s credentials
eReverse engineer, decompile or disassemble software or components made available through the Site, save to the extent permitted by mandatory rules of law
fUpload or transmit malware, malicious code or harmful content
gRepublish Site content while concealing or altering its source, or create the impression of a relationship with Zerone that does not exist
ğFrame or embed any part of the Site within another page without Zerone’s consent

B.5.3. The acts of observing, studying and testing a program, and of decompilation for interoperability purposes, permitted under Article 38(5) and Article 38(6) of Law No. 5846, are reserved. This Section does not prohibit conduct permitted by those mandatory provisions.

B.5.4. Security researchers may report vulnerabilities identified on the Site or in Zerone products in accordance with 51-zafiyet-bildirim-politikasi.md (Vulnerability Disclosure Policy). Research conducted in compliance with that policy constitutes an exception to the prohibition in Section B.5.2(c).

B.5.5. Where Zerone identifies use contrary to this Section, it may apply technical measures to restrict access for the relevant IP address or user and may pursue legal remedies.

B.6.1. The Site may link to websites operated by third parties. Such links are provided for convenience only.

B.6.2. Zerone exercises no control over, and accepts no responsibility for, the content, security, availability or privacy practices of linked sites or the products and services offered there. The presence of a link does not constitute endorsement, recommendation or warranty.

B.6.3. Upon following a link, the Visitor becomes subject to the terms of use and privacy notice of the destination site.

B.7. Visitor-submitted content

B.7.1. A Visitor may submit content to Zerone through contact forms, demo requests, job applications, newsletter sign-ups, feedback, comments or direct e-mail (“Visitor Content”).

B.7.2. The Visitor represents that the content submitted does not infringe third-party intellectual property rights, confidentiality obligations or data protection requirements. The Visitor shall not submit third-party confidential information or personal data without authorisation.

B.7.3. In respect of suggestions, ideas and feedback submitted for the improvement of products and services, the Visitor grants Zerone a perpetual, worldwide, non-exclusive, transferable, sub-licensable and royalty-free right of use. Zerone may use such feedback in its products and documentation, and no fee or attribution obligation shall arise from such use.

B.7.4. The grant of rights under this Section does not apply to personal data contained in Visitor Content. Personal data is processed solely for the purposes and on the legal bases set out in 61-web-sitesi-gizlilik-ve-cerez-metni.md.

B.7.5. Zerone reserves the right not to publish, or to remove, Visitor Content that is unlawful, misleading, defamatory or infringing of third-party rights.

B.8. Disclaimer of warranties and limitation of liability

B.8.1. The Site and its content are provided “as is”. Zerone does not warrant that the Site will operate without interruption or error, that the content will at all times be current, complete and accurate, or that the Site and its servers will be free of malicious code.

B.8.2. Zerone shall not be liable for use of or inability to use the Site, for decisions taken in reliance on Site content, or for loss of data, loss of profit, loss of business or indirect damages.

B.8.3. Zerone’s aggregate liability under these Terms is in all cases limited to the direct damage suffered by the Visitor. As the Site is made available free of charge, no fee has been paid to Zerone in respect of use of the Site.

B.8.4. The limitations in this Section shall not apply in cases of Zerone’s wilful misconduct or gross negligence, or to the extent mandatory rules of law, in particular Article 115 of the Turkish Code of Obligations No. 6098, do not so permit.

B.9. Personal data and cookies

B.9.1. The personal data processed in connection with visits to the Site, the purposes and legal bases of processing, retention periods, transfers, the use of cookies and browser storage, and the rights listed in Article 11 of Law No. 6698 on the Protection of Personal Data, are described in 61-web-sitesi-gizlilik-ve-cerez-metni.md (Website Visitor Privacy and Cookie Notice).

B.9.2. A data subject may exercise the rights listed in Article 11 of that Law by delivering a wet-signed petition to the address in Section B.2.1 in person or by post, by sending a request signed with a secure electronic signature or mobile signature to kvkk@zeronesecurity.com, or by sending a request from an electronic mail address previously notified to Zerone and registered in Zerone’s systems to the same address. Requests are concluded within thirty days at the latest.

B.9.3. Activities carried out by Zerone as a processor on behalf of the Customer within the scope of the Zero Door service fall outside this Section and are governed by the Data Processing Agreement.

B.10. Changes, governing law and jurisdiction

B.10.1. Zerone may update these Terms. The updated text takes effect from the effective date stated on it and applies only to visits occurring after that date. Changes have no retroactive effect. The version and effective date of the text in force are shown at the head of this document.

B.10.2. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

B.10.3. These Terms are governed by the laws of the Republic of Türkiye.

B.10.4. The Courts and Execution Offices of Adana shall have jurisdiction over disputes arising out of these Terms. Where the Visitor qualifies as a consumer within the meaning of Law No. 6502 on Consumer Protection, the jurisdiction of the courts of the consumer’s place of residence and of the consumer arbitration committees according to the applicable monetary thresholds is reserved pursuant to Article 73(5) of that Law.

B.11. Status under Law No. 5651 and content complaints

B.11.1. In respect of the content it publishes on the Site, Zerone is a content provider within the meaning of Article 2 of Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications, and is responsible for all content it makes available on the internet pursuant to Article 4(1) of that Law.

B.11.2. Zerone does not operate on the Site an environment allowing users to create, view or share content freely. Zerone is therefore not a social network provider within the meaning of that Law in respect of the Site. Zerone does not provide Visitors with access to the internet and is accordingly not an access provider.

B.11.3. To the extent that Zerone hosts Customer data within the scope of the Zero Door service, it is acknowledged that such activity falls within the wording of the hosting provider definition; that environment is nevertheless an authenticated, non-public and tenant-isolated corporate processing environment. Access and transaction records relating to that environment are retained with their integrity preserved for the periods set out in the retention documentation.

B.11.4. Any person who considers that content on the Site infringes personality rights, intellectual property rights or other requirements of lawfulness may submit a complaint to contact@zeronesecurity.com. The complaint shall state the complainant’s name or trade name, contact details, the full address (URL) of the content complained of, an explanation of the nature of the infringement, and information and documents evidencing entitlement.

B.11.5. Zerone shall examine duly submitted complaints without undue delay, remove or correct the content where it finds the request justified, and notify the complainant of the outcome. This channel does not affect the right of interested parties to pursue the judicial remedies provided for in Articles 9 and 9/A of Law No. 5651.
